Terms & Conditions for "The Explorer Thailand" Application

Please read these terms and conditions carefully before using the "The Explorer Thailand" application operated by The Explorer Thailand Co, Ltd.

By accessing or using the application, you agree to be bound by these terms and conditions. If you disagree with any part of these terms and conditions, you may not use the application.

1. Acceptance of Terms

3.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

4. Discounts and Offers

4.1. "The Explorer Thailand" application provides access to discounts, offers, and promotions for restaurants, hotels, and activities in Hua Hin, Thailand. These discounts, offers, and promotions are provided by third-party vendors and are subject to their terms and conditions.

4.2. The Explorer Thailand Co, Ltd. does not guarantee the availability of any discounts, offers, or promotions and is not responsible for any changes or discontinuation of such discounts, offers, or promotions by third-party vendors.

4.3. You acknowledge and agree that the discounts, offers, and promotions provided through the application may be subject to restrictions and limitations imposed by third-party vendors, including but not limited to blackout dates, expiration dates, and usage limits.

5. Intellectual Property

5.1. The content, design, and layout of "The Explorer Thailand" application, including but not limited to text, graphics, images, logos, and software, are owned by The Explorer Thailand Co, Ltd. and are protected by copyright and other intellectual property laws.

5.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the application without the prior written consent of The Explorer Thailand Co, Ltd.

6. Limitation of Liability

6.1. To the fullest extent permitted by applicable law, The Explorer Thailand Co, Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the application; (ii) any conduct or content of any third party on the application; or (iii) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not The Explorer Thailand Co, Ltd. has been informed of the possibility of such damage.

7. Governing Law

7.1. These terms and conditions shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law principles.

8. Changes to Terms and Conditions

8.1. The Explorer Thailand Co, Ltd. reserves the right to modify or replace these terms and conditions at any time. If a revision is material, The Explorer Thailand Co, Ltd. will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at The Explorer Thailand Co, Ltd. sole discretion.

8.2. By continuing to access or use the application after any revisions become effective, you agree to be bound by the revised terms and conditions. If you do not agree to the new terms and conditions, please stop using the application.
